Carbondale health care provider accuses telemarketers of unlawful business practices

BENTON — A Carbondale health care provider filed a class action lawsuit against Park Ridge telemarketers for allegedly sending unsolicited faxes. 

Dr. Richard Thalman, doing business as Thalman Chiropractic & Wellness Center, individually and on behalf of all others similarly situated, filed a complaint Dec. 14 in U.S. District Court for the Southern District of Illinois Benton Division against Medical Business Bureau LLC and John Does 1-10, alleging violation of the Telephone Consumer Protection Act and the Illinois Consumer Fraud Act.

According to the complaint, Thalman Chiropractic suffered damages as a result of receiving unsolicited faxes, in the form of paper and ink or toner consumed. The plaintiff alleges Medical Business Bureau transmitted unsolicited fax advertisements to the plaintiff without its permission or consent.

Thalman Chiropractic & Wellness Center seeks trial by jury, an injunction against the further transmission of unsolicited fax advertising, actual and statutory damages, court costs and all other just and proper relief.
