Suit alleges motorist struck, killed man assisting another driver

EDWARDSVILLE — A truck driver was allegedly struck and killed while attempting to assist another motorist who had gone off the road. 

Marc Kramer, personal representative of the estate of Steven Greene, deceased, filed a complaint Dec. 18 in Madison County Circuit Court against Gabriel Ruiz, alleging the driver failed to maintain his vehicle in its proper lane.

According to the complaint, Greene was driving a truck on Dec. 22, 2016, when he stopped to assist another motorist who had gone off the road on state Highway 111 in Nameoki Township. While helping the other motorist, Greene was allegedly struck and killed by Ruiz. 

The plaintiff alleges Ruiz negligently drove his vehicle at an excessive speed, failed to keep proper lookout and failed to slow down or stop his vehicle to avoid striking Greene.

Kramer seeks trial by jury, judgment greater than $50,000, plus court costs and interest. He is represented by attorneys Jennifer Sutmoeller, Phillip A. Cervantes and Michael T. Flachs, Jr. of Cervantes & Associates in St. Louis.
