Lawsuits

EDWARDSVILLE — A Madison County food safety inspector claims she injured her foot at Rib City in Alton.

Madison County, on behalf of Candice Zipfel, filed a complaint Dec. 10 in Madison County Circuit Court against Rib City Alton LLC, alleging failure to maintain its premises in a reasonably safe condition.

According to the complaint, Zipfel was conducting a food safety inspection at Rib City in Alton on Dec. 14, 2016, when the lid of an ice machine fell off and injured the plaintiff.

The suit states that Zipfel injured her left foot and ankle. She also claims she incurred medical expenses requiring temporary total disability benefits and permanent partial disability benefits.

The plaintiff alleges Rib City failed to maintain its equipment in proper working condition and failed to provide adequate warning of any existing danger.

Madison County seeks trial by jury, judgment sufficient to satisfy the plaintiff's subrogation lien, plus court costs. It is represented by attorney Matthew W. Kelly of Schrempf, Kelly & Napp Ltd. in Alton.
