Woman sues Ace Hardware over slip, fall on loose rock

BELLEVILLE — A woman claims she slipped on loose lava rock and fell in the parking lot of Ace Hardware. 

Judy Behrman filed a complaint on Nov. 27 in the St. Clair County Circuit Court against Home Brite, doing business as Ace Hardware Corp., alleging it failed to ensure the safety of its invitees.

According to the complaint, the plaintiff alleges that on June 4, she was a customer at Ace Hardware when she allegedly slipped on loose lava rock, hit her head on an iron pipe and fell onto the parking lot pavement. 

She claims she sustained serious injuries to her wrist which required surgery and hospitalization. 

The plaintiff alleges the defendant negligently exhibited merchandise in a viewing area which would likely cause persons to fall on loose rock.

The plaintiff requests a trial by jury and seeks damages of not less than $50,000, plus costs and any further relief as the court finds fair and just. She is represented by Paul M. Storment Jr. of Paul M. Storment Jr. PC in Belleville.
