Property owners allege insurer ignored fire claim

EDWARDSVILLE — Property owners are suing Country Financial for allegedly failing to respond to their claim after a fire destroyed an outbuilding. 

Tim Patterson and Dawn Patterson, n/k/a Dawn Ward filed a complaint on Nov. 26 in the Madison County Circuit Court against Country Mutual Insurance Co., doing business as Country Financial, alleging the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that on Feb. 5, 2017, a fire occurred in an insured outbuilding owned by the plaintiffs, destroying the structure and its contents. At the time of the occurrence, the insurance policy issued by Country Financial was in full force and effect, the suit states. The plaintiffs allegedly made a claim for full coverage. 

The plaintiffs allege the defendant failed to respond to their claim for payment and failed to pay all or a portion of the claim.

The plaintiffs seek judgment against the defendant in an amount exceeding $50,000, plus interest, penalties, attorney's fees and costs. They are represented by Eric Kirkpatrick of Kirkpatrick Law Offices PC in Belleville.
