EDWARDSVILLE — A motorist is suing a cab driver for allegedly causing a collision.

Daniel J. Barton filed a complaint on Nov. 30 in the Madison County Circuit Court against Checker Cab of Granite City Ltd. and Scott A. Prater, alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 23, he was injured when Prater caused a collision near the intersection of W. Pontoon Road and W. Missouri Avenue.

Barton claims he sustained serious and permanent injuries to his neck, back and knees.

The plaintiff alleges Prater breached his duty to exercise the highest degree of care for the safety of others upon the roadway, failed to keep proper lookout and negligently used a cellphone while driving Checker's cab at an excessive speed.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount greater than $50,000, plus costs and such other relief that is just and proper. He is represented by Christopher S. Saracino of Goldblatt + Singer in St. Louis.
