Glen Carbon property owners allege buyers breached contract

EDWARDSVILLE — Glen Carbon property owners are suing the buyers for allegedly failing to make payments. 

David L. Stewart and Emma B. Stewart filed a complaint on Nov. 20 in the Madison County Circuit Court against Covenant Land Partnership LLC, Old Troy One Trust and Manny Segura, alleging they failed to perform all terms and conditions required in the contract.

According to the complaint, the plaintiffs allege that on Sept. 7, 2016, the defendants agreed to purchase a property located at 2947 Old Troy Road in Glen Carbon for $135,000. After 24 months from the date of the contract, the balance of $127,000 remains due and owing, the suit states. 

The plaintiffs allege the defendants took possession of the title of the property without paying the full amount due under the contract.

The plaintiffs request a trial by jury and seek an order compelling the defendants to convey by warranty deed, all rights, title and interest on the real estate, and award for all damages in excess of $50,000, plus attorney's fees and costs.
