Customer sues Goodwill over alleged injuries at Fairview Heights store

BELLEVILLE — A customer claims he was injured when a table top was dropped on his foot at the Fairview heights Goodwill. 

Ernest Josato filed a complaint on Nov. 8 in the St. Clair County Circuit Court against Mers/Illinois Goodwill Industries Inc., alleging negligence. 

According to the complaint, the plaintiff alleges that on Nov. 14, 2016, he was a customer at the Goodwill store in Fairview Heights when an employee dropped a table top set near the cash register, which allegedly landed on the plaintiff's feet. He alleges the table top set was negligently placed on the counter near the cash register. 

As a result, Josato claims he incurred medical bills, endured great pain, suffering and disability. 

The plaintiff alleges the defendant failed to provide adequate warning of the table top being in the area near the counter.

The plaintiff requests a trial by jury and seeks damages in an amount in excess of $50,000, plus costs and any further relief as the court deems just and proper. He is represented by Mary M. Stewart and Michael J. Brunton of Brunton Law Offices PC in Collinsville.
