Employer accused of making late pension contributions

BENTON — Pension fund trustees are suing an employer for allegedly making late payments into pension plans. 

Cement Masons Local 527, et al, filed a complaint on Nov. 1 in the U.S. District Court for the Southern District of Illinois against Zoie LLC, alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that between March and December 2017, the defendant failed to make monthly reports showing the number of hours worked by all covered employees and failed to contribute on a monthly basis to the plaintiffs' funds. 

As a result, the plaintiffs claim they were damaged in the amount of $3,402.59 for late-paid contributions and incurred related fees and costs. 

The plaintiffs request a trial by jury and seek damages in the amount of $3,402.59, plus attorneys' fees, costs and all further relief as the court may deem just and proper.
