Employee benefit fund sues construction company for unpaid contributions

BENTON — Employee benefit fund trustees is suing C. Howell Construction Inc., an employer, citing alleged breach of collective bargaining agreements.

General Laborers' Pension Fund, et al, filed a complaint on Nov. 2, in the U.S. District Court for the Southern District of Illinois, against C. Howell Construction Inc. alleging that the employer violated the Employee Retirement Income Security Act.

The trustees allege that from March-August, there were unpaid contributions and liquidated damages totaling $3,305.67. 

The plaintiff holds C. Howell Construction Inc. responsible because the defendant allegedly failed to pay contributions on behalf of covered employees.

The plaintiff requests a trial by jury and seeks damages in the amount of $3,305.67, interest, costs and such other legal or equitable relief as the court deems appropriate.
