Woman accuses car dealership, lender of fraud

BELLEVILLE — A woman claims a car dealership refused to make repairs on a defective vehicle, which was later repossessed by the lender. 

Ashley R. Dick filed a complaint on Oct. 26 in the St. Clair County Circuit Court against Cardinal Buick GMC Inc. and Credit Acceptance Corporation, alleging they violated the Illinois Consumer Fraud Act.

According to the complaint, the plaintiff alleges that on April 25, she purchased a used 2007 GMC Buick Arcadia 4D from Cardinal Buick and was financed by Credit Acceptance. As she was driving home, the engine light came on with two codes indicating that the transmission was defective and that a solenoid needed replacement, the suit states. 

As a result, Dick claims she has been damaged in the total amount of $10,616.96 and incurred attorney's fees in excess of $20,000. 

The plaintiff alleges the defendants refused to perform necessary repairs and to replace the solenoid and repossessed the vehicle after she stopped payment.

The plaintiff requests a trial by jury and seeks judgment against defendants for a sum greater than $100,000, plus costs. She is represented by David M. Duree of David M. Duree & Associates PC in O'Fallon.
