BELLEVILLE — A woman is suing after her daughter allegedly fell off a playground while under the care of Kim's Kid Inc.
Khloe Butler, by her mother and next friend Karrington Butler, and Karrington Butler filed a complaint on Oct. 29 in the St. Clair County Circuit Court against Kim's Kid Inc. alleging the defendant failed to properly supervise Khloe Butler.
According to the complaint, the plaintiffs allege that on June 17, Khloe Butler was under the care and supervision of Kim's Kid when she fell off the playground equipment onto the hard surface.
As a result, Khloe Butler suffered injuries and had to endure great pain and emotional suffering. Karrington Butler has become liable for medical expenses, the suit states.
The plaintiffs allege the defendant negligently allowed Khloe Butler to use playground equipment that the defendant should have known she was too small and young to play on.
The plaintiffs request a trial by jury and seek judgment against defendant for a sum in excess of $50,000. They are represented by Eric Kirkpatrick of Kirkpatrick Law Offices PC in Belleville.
