Suit alleges driver caused crash by hitting accelerator instead of brake pedal

BELLEVILLE — Three women allege a motorist hit the accelerator instead of the brake pedal, causing a rear-end collision in Swansea. 

Martenia Jones, Marriah Jones-White and Makayla Jones filed a complaint on Oct. 30 in the St. Clair County Circuit Court against Daizjah Day, alleging she failed to maintain proper control of the vehicle.

According to the complaint, the plaintiffs allege that on Oct. 30, 2017, they were traveling at or near the intersection of IL 161 and IL 159 in Swansea when the defendant struck the rear of their vehicle. 

They claim they suffered injuries and damages and incurred costs for medical care and treatment expenses. 

The plaintiffs hold Day responsible because the defendant allegedly stepped on the accelerator of the vehicle instead of the brake pedal.

The plaintiffs request a trial by jury and seek a judgment in their favor for damages greater than $50,000 for each of them and all other relief the court deems just and proper. They are represented by Mark A. Cantor of Cantor Injury Law LLC in St. Louis.
