Man alleges he was hit while trying to assist an overturned vehicle

EDWARDSVILLE — A man claims he was injured when a semi-truck caused a collision with another car, which then hit him while he assisted with an overturned vehicle. 

Zachary T. Stewart filed a complaint on Oct. 19 in the Madison County Circuit Court against Granton Samboja Kirombo, GP Transportation Co., Transmara Freight Inc. and Z.A. Transport Inc., alleging Kirombo failed to exercise reasonable care to avoid causing injury to others.

According to the complaint, the plaintiff alleges that on Dec. 16, 2016, he was attempting to assist with an overturned vehicle in the median of I-70 when Kirombo caused the Freightliner semi-truck he was driving to collide with another vehicle, causing it in turn and hit the plaintiff. 

As a result, Stewart claims he suffered injuries and trauma to his lower right leg, ankle and foot and incurred medical expenses in excess of $50,000. 

The plaintiff alleges Kirombo failed to maintain a proper speed and failed to stop, swerve or reduce speed to avoid the collision.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount in excess of $50,000, plus costs. He is represented by Thomas E. Hildebrand of Hildebrand Law Office in Granite City.
