BELLEVILLE — A wrongful death lawsuit alleges an intoxicated driver caused a fatal collision after consuming alcohol at the Leighton Evatt American Legion, Post 365.

William Edward Hopkins, administrator for the estate of Bryan Hopkins, and grandfather of Kole Hopkins, filed a complaint on Oct. 19 in the St. Clair County Circuit Court, against Jordan Dimauro and Leighton Evatt American Legion, Post 365.

The plaintiffs allege that on Oct. 21, 2017, Dimauro negligently drove his vehicle while intoxicated, with a blood alcohol level that exceeded the legal limit. Dimauro's vehicle struck Bryan Hopkins.

Bryan Hopkins died from his injuries as a result of defendants' negligence, the suit states.

The plaintiffs allege the American Legion negligently gave, sold or provided alcohol to Dimauro.

The plaintiffs request a trial by jury and seek damages of more than $50,000, plus costs.

They are represented by Justin M. Whitton of Whitton Group LLC in Belleville.
