Edwardsville property buyers accuse sellers of fraud

EDWARDSVILLE — Edwardsville property buyers are suing the sellers for allegedly failing to disclose water damage.

Quinten Randolph and Jacqueline Randolph filed a complaint on Oct. 12 in the Madison County Circuit Court against Robert Steinbraker, Kathleen Steinbraker, Diana Massey, Mark Massey and Berkshire Hathway Homeservices Elite Properties, alleging fraud. 

According to the complaint, the plaintiffs allege that on May 2, they entered into a contract with the defendants for the purchase of a property located at 50 Birdie Court in Edwardsville. After taking possession, the plaintiffs discovered approximately 15 patch holes on the basement floor and the basement floor itself dropped six inches towards the corner. They later learned that the home had sustained water damage in March. 

The plaintiffs allege the defendants falsely represented that the property was in superior condition with no material defects. 

The plaintiffs seek a judgment in their favor in an amount in excess of $100,000 plus all other relief that is proper and just. He is represented by Megan M. Gilbreth of Blake Behme Law Group PC in Belleville.
