Caseyville neighbors sue over alleged property dispute

BELLEVILLE — A Caseyville couple allege their neighbors encroached on their property and then attempted to damage their trucking business after they made complaints. 

Kim Holmes and Sherry Holmes filed a complaint on Sept. 28 in St. Clair County Circuit Court against Kurt Take and Rebecca Take, alleging they illegally encroached on the plaintiffs' property.

According to the complaint, the defendants planted trees and constructed part of a barn on the plaintiffs' property. After the plaintiffs sent letters, the defendants dumped nails and screws on their property to try and shut down their trucking business, the complaint states. The plaintiffs' claim the defendants also spread false statements to their neighbors and the police. 

The plaintiffs request a trial by jury and seek damages of not less than $50,000. They are represented by Benedict Y. Song of Chatham & Baricevic in Belleville.
