Patient alleges doctor failed to diagnose neurological condition

EDWARDSVILLE — A patient s suing a physician, alleging her neurological condition went undiagnosed. 

Heather L. Roberts and Chat Roberts filed a complaint on Sept. 18 in the Madison County Circuit Court against Dr. Richard Nicol, alleging he failed to act as a reasonably well qualified emergency physician.

According to the complaint, Heather Roberts alleges that on July 21, 2017, she came under the care and treatment of Nicol, who failed to diagnose and treat her condition. 

The plaintiff claims she suffered severe and permanent injuries, resulting in lost wages, pain and suffering, medical expenses and disability. Chat Roberts claims he was deprived of the service, affection and companionship of his spouse. 

The plaintiffs hold Nicol responsible because he allegedly failed to timely and appropriately treat and monitor the patient's neurological condition and failed to request appropriate tests.

The plaintiffs request a trial by jury and seek damages of not less than $50,000, plus costs and all further relief deemed proper and just. They are represented by J. Michael Weilmuenster of Weilmuenster & Keck PC in Belleville.
