Tenant allegedly breached lease agreement

EDWARDSVILLE — Property owners in Marysville allege a tenant breached a lease agreement.

James Shepard and Sandra Shepard filed a complaint on Sept. 6 in Madison County Circuit Court against Myong Kim, alleging that the tenant violated the terms of the agreement.

According to the complaint, Kim agreed to lease the plaintiffs' property for five years, ending June 2016. Under the agreement, the lease automatically renewed at an increased rate. Then two years later, Kim vacated the property with just a 30-day notice. 

As a result of defendant's breach of contract, the plaintiffs incurred damages for lost rental income totaling $55,260 and the property remains vacant, the suit states. 

The plaintiffs request a trial by jury and seek damages, including but not limited to the loss of rental income, lost of time and expenses in mitigating damages and attorney's fees. They are represented by Todd W. Sivia and Paul A. Marks of Sivia Law in Edwardsville.
