Pension fund groups sue contractor over $218 in unpaid contributions

BENTON — Three pension fund management groups are suing a local contractor for failing to pay $218. 24 in contributions. 

Central Laborers' Pension Fund, Central Laborers' Welfare Fund, Central Laborers' Annuity Fund and Russell Davenport, as trustee, filed a complaint on Aug. 10 in the U.S. District Court for the Southern District of Illinois against E.A. Masonry Inc., alleging the employer violated the Employee Retirement Income Security Act.

According to the complaint, the defendants did not pay contributions on behalf of its employees per a collective bargaining agreement. that the parties entered into a collective bargaining agreement to which defendant agreed to pay  to plaintiffs funds. 

The plaintiffs request a trial by jury and seek the unpaid amount with interest and attorney fees. They are represented by Leticia B. Wiggins and Kelly R. Phelps of Jelliffe, Doerge & Phelps in Harrisburg.
