Fund administrators seek landscaping company's alleged unpaid contributions

BENTON — A pension management group accuses a landscaping service of unpaid contributions.

Central Laborers' Pension, Welfare and Annuity Funds filed a complaint on Aug. 13 in the U.S. District Court for the Southern District of Illinois against Mason's Landscaping & Construction Services Inc and its owner, William Mason. 

The group alleges Mason's Landscaping violated the Employee Retirement Income Security Act.

According to the complaint, the defendants agreed to pay employee contributions toward the fund. But an audit shows Mason's Landscaping did not submit all the money or properly report the employees' hours, the complaint states. 

The plaintiff requests a trial by jury and seeks damages of more than $29,000, plus interest and attorney fees. interest. It is represented by Patrick R. Foley of Foley & Kelly in Belleville.
