Woman sues driver for hitting parked car

BELLEVILLE — A woman claims she suffered injuries when a driver struck the parked car she was sitting on. 

Niquila Ousley filed a complaint on July 30 in the St. Clair County Circuit Court against Bertha Holmes Lee, alleging she her duty to exercise reasonable care for the safety of others.

According to the complaint, the plaintiff alleges that on April 8, 2017, she was sitting on a vehicle that was legally parked across from 1316 Windstanley Avenue. Lee was driving a pickup truck when she allegedly struck the parked vehicle the plaintiff was sitting on. 

Ousley claims she suffered serious and permanent injuries resulting in pain, medical expenses and loss of enjoyment of life. 

The plaintiff holds Lee responsible because the defendant allegedly failed to maintain proper control of her vehicle, failed to keep proper lookout and failed to properly apply brakes to avoid colliding with the plaintiff's vehicle.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount exceeding $50,000, plus costs. She is represented by Katherine E. Perry of Shay & Associates in Springfield.
