Lender alleges borrower breached contract

BELLEVILLE — A lender is suing a borrower for allegedly failing to make payments on a loan. 

Kevin Edwards filed a complaint on Aug. 3 in the St. Clair County Circuit Court against Michael Bilbrey, alleging he failed to pay his indebtedness.

According to the complaint, the plaintiff alleges that on Oct. 10, 2007, the Bilbrey executed a promissory note in the amount of $50,000 with interest of 10% per annum. After receiving one payment of $20,000 on Jan. 9, 2008, the principal amount of $30,000 plus interest of $34,248.10 remains unpaid. The plaintiff alleges the defendant has failed to make any other payments. 

The plaintiff requests a trial by jury and seeks judgment in its favor in the amount of $64,248.10. plus post-judgment interest, attorney's fees, costs and all other relief deemed just and proper. He is represented by Justin A. Welply and Brian M. Wacker of SmithAmundsen LLC in Clayton.
