Former Express Scripts employee sues over denial of disability benefits

BENTON — An Illinois man says his former employer and an insurance company wrongfully denied him long-term disability benefits.

Corey Byrd filed a complaint on June 18 in the U.S. District Court for the Southern District of Illinois against Express Scripts Holding Company and Metropolitan Life Insurance Company, alleging that they violated the Employee Retirement Income Security Act.

According to the complaint, Byrd suffered a foot injury requiring the amputation of three toes in 2006 and multiple surgeries. Byrd claims Express Scripts fired him after he could not return to work and Metropolitan Life Insurance denied his benefits after claiming he suffered from a pre-existing condition. 

Byrd seeks a jury trial and damages for unpaid disability benefits, attorney’s fees and costs . He is represented by Matthew R. Davis and Candace A. Weatherfield of Gallagher Davis in St. Louis.
