McLanahan Towing in legal tussle with J&L Services and insurers

EDWARDSVILLE — McLanahan Towing Inc. faces a negligence lawsuit after a truck driver allegedly began lifting a vehicle while the driver was still gathering items. 

Carolina Casualty Insurance Company and Berkleynet Underwriters, as assignees of Larry Allen and J&L Services Inc., filed a complaint on July 10 in Madison County Circuit Court against McLanahan Towing Inc. and an unidentified employee - exactly two years after the underlying incident occurred.

According to the complaint, Allen's truck broke down and he called a tow truck driver from McLanahan Towing. As Allen retrieved items from his truck, the tow truck driver began lifting the vehicle, the complaint states. Allen fell and severely injured his leg.

As a result of the injury, Allen's employer, J&L Services, must make workers' compensation payments to him. The plaintiffs claim McLanahan Towing is responsible for its employee's negligence. 

The plaintiffs request a trial by jury and seek damages, costs and attorney fees. They are represented by Heath Sherman of Nyhan, Bambrick, Kinzie & Lowry in Chicago.

Allen filed a related complaint on July 10 in Madison County Circuit Court against McLanahan Towing, alleging the tow truck company did not properly train its employees. 

Allen requests a trial by jury and seeks more than $50,000 in damages. He is represented by Nicholis J. Stein in Hawthorn Woods.
