BELLEVILLE — Consumers have filed a class action lawsuit against Campbell Soup for allegedly using preservatives in tomato soup varieties that are represented as containing no preservatives.

Daniele Schwartz and Haunah Vanlaningham, individually and on behalf of all others similarly situated, filed a complaint on June 21 in the St. Clair County Circuit Court against Campbell Soup Co. alleging it violated the Illinois Consumer Fraud and Deceptive Business Practices Act.

According to the complaint, the plaintiffs allege they purchased Campbell's Slow Kettle Style Tomato & Sweet Basil Bisque for $3.89 and Home Style Harvest Tomato with Basil for $2.49 at Target. They allege the defendants deceptively and unfairly represented that the products did not contain preservatives. However, the plaintiffs claim the products contain citric acid, ascorbic acid, and/or succinic acid, which are all preservatives.

The plaintiffs claim they have been damaged for paying more for products than it actually costs.

The plaintiffs request a trial by jury and seek an order certifying this case as a class action and appointing the plaintiffs and their counsels as representatives. They also seek compensatory damages, interest, costs and fees and all further relief as the court deems just and proper.

They are represented by David C. Nelson of Nelson & Nelson, Attorneys at Law in Belleville, IL and Matthew H. Armstrong of Armstrong Law Firm LLC in St. Louis.
