Mother files wrongful death suit against healthcare providers

BELLEVILLE — A mother is suing healthcare providers alleging her son's condition was misdiagnosed, resulting in his death. 

Diane Titley, as administrator of the estate of James E. Malone, deceased filed a complaint on June 6, in the St. Clair County Circuit Court against The Country Doctor Ltd., O.A. Associates LLC, et al. alleging they negligently deviated from the established clinical guidelines.

According to the complaint, the plaintiff alleges that on May 31, 2016, Malone was seen by the defendants due to left knee pain. The plaintiff alleges the defendants misdiagnosed Malone's medical condition, failed to administer broad spectrum antibiotics and antifungal medications and failed to recognize or react to evidence of a worsening condition.

As a result, Malone died on July 3, 2016, due to pulmonary blastomycosis with diffuse inflammation, necrosis and hemorrhage, resulting from osteomyelitis/mystosis of his left knee. 

The plaintiff requests a trial by jury and seeks judgment against the defendants in excess of $50,000, plus costs and all other relief deemed proper and just.
