Edwardsville residents allege JMC Concrete improperly installed pool

EDWARDSVILLE – An Edwardsville couple claims a pool they had built at their home was improperly installed.

Carl Hennig and Dawn Hennig filed a complaint on June 14 in the Madison County Circuit Court against Leisure Pools and Spas Manufacturing North America Inc., JMC Concrete LLC and Donald Wichmer, alleging breach of contract and other counts.

According to the complaint, the plaintiffs allege that on Aug. 27, 2011, they contracted JMC, an authorized dealer for Leisure Pools, to install a 34-foot fiberglass pool on their property for $47,325. The suit states the pool was completed in November, covered for the winter, and opened in April 2012.

The plaintiffs allege that the pool was improperly installed and that it has dropped on one end and risen on the other. They allege none of the defendants have agreed to correct the damage due to the allegedly incompetent workmanship.

The plaintiffs allege the defendants failed to perform their obligations under the contract.

The plaintiffs request a trial by jury and seek and order requiring defendants to properly repair the pool and put it back to its original install state and award for damages, attorney's fees, costs and all other relief that are just and proper.
