Dentist office alleges trademark infringement

BENTON — Troy Family Dental is suing Troy Dental Care for alleged trademark dilution and unfair competition.

Troy Family Dental filed a complaint on May 1 in the U.S. District Court for the Southern District of Illinois against Dr. William J. Waters DMD, doing business as Troy Dental Care, alleging the defendant violated the Lanham Act.

According to the complaint, the plaintiff alleges Troy Dental Care adopted a confusingly similar name in order to mislead patients into believing that the defendant was associated with the plaintiff.

The plaintiff claims the defendant's alleged actions have irreparably damaged its business.

The plaintiff requests a trial by jury and seeks an injunction ordering the defendant to stop using the name Troy Dental Care, plus an award for actual and statutory damages, disgorgement of profits derived from the defendant's conduct, interest, costs, attorney's fees and all other relief that is just and proper.
