A&A Hauling accused of failing to make employee contributions

EAST ST. LOUIS — Two employee benefit fund administrators are suing A & A Hauling for allegedly failing to make contributions.

The Employers and Cement Masons No. 90 Health & Welfare Fund and the Employers and Cement Masons No. 90 Pension Fund filed a complaint on May 18 in the U.S. District Court for the Southern District of Illinois against A & A Hauling Inc., alleging it violated the Labor Management Relations Act and the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege the defendant failed to comply with the terms of an agreement by failing and refusing pay all of its required contributions for October 2017. 

As a result of the defendant's alleged actions, the plaintiffs' employee welfare benefit funds have been damaged in the amount of $16,891.35, the suit states.

The plaintiffs request a trial by jury and seeks judgment in the amount of $16,891.35, liquidated damages of $3,378.27 and past liquidated damages of $18,840.36, plus interest, legal fees, costs, expenses and all other relief that is proper.
