Taylor Roofing Solutions accused of trademark infringement

BENTON — A roofing company is accused of alleged trademark infringement and unfair competition.

W. James Taylor Inc., doing business as Jim Taylor Inc., filed a complaint on May 11 in the U.S. District Court for the Southern District of Illinois against Taylor Roofing Solutions Inc. and Gerrit Yank, alleging they wrongfully used its trademark and logo.

According to the complaint, the plaintiff claims it has operated under the name “Taylor Roofing" since 1982. In 2017, the plaintiff allegedly told the defendants to stop using the Taylor name, but they refused, the suit states. 

The plaintiff claims that defendants' actions likely caused confusion among consumers, and the plaintiff holds them responsible for continuing to use the Taylor name.

The plaintiff requests a trial by jury and seeks an order declaring that it is the owner of the said marks and logo and any further relief that this court deems appropriate. 

The plaintiff is represented by Philip J. Lading and Douglas D. Churovich of Sandberg Phoenix & von Gontard PC in Edwardsville.
