City of Mounds accused of failing to make settlement payments

BENTON — A company is suing the City of Mounds for allegedly breaching a settlement agreement reached after the Fifth District ordered mediation.

Westmore Equities LLC filed a complaint on May 17 in the U.S. District Court for the Southern District of Illinois against the City of Mounds, alleging it failed to perform its obligations under an agreement.

According to the complaint, the plaintiff alleges that on Aug. 28, 2017, the U.S. Court of Appeals for the Seventh Circuit ordered the parties to engage in mediation with a circuit mediator. The two parties then allegedly reached a settlement agreement, the suit states. However, Westmore claims the defendant failed and refused to timely make settlement payments. 

The plaintiff requests a trial by jury and seeks actual damages, pre-judgment and post-judgment interest, the costs of the suit and any other relief that is just and proper.
