EDWARDSVILLE — The owner of a Dodge truck is suing the driver for allegedly falling asleep at the wheel and causing the vehicle to overturn on the highway.
Phillip Haas filed a complaint on June 4 in the Madison County Circuit Court against Garet Looper, alleging he negligently fell asleep while driving.
According to the complaint, the plaintiff alleges that on June 4, 2016, Looper was driving the plaintiff's Dodge truck when he fell asleep and lost control. The defendant allegedly struck a delineator post and guardrail and then overturned on the highway.
Haas claims he suffered injuries to his neck, back, shoulders and head.
The plaintiff alleges Looper drove at an excessive speed, failed to make proper maneuvers and overcorrected when he drove off the roadway.
The plaintiff requests a trial by jury and seeks judgment against the defendant for an equitable sum of more than $50,000, plus costs.
