EDWARDSVILLE — A O'Fallon man is suing property owners after he allegedly fell down stairs that were covered with leaves.
Jessie R. Carter filed a complaint on June 1 in the Madison County Circuit Court against Matthew Barbee and Aufiero Jasmine Barbee, alleging the defendants failed to maintain their stairs in a reasonably safe condition.
According to the complaint, the plaintiff alleges he was walking on the defendants' property on Oct. 18 when he allegedly stumbled and fell down stairs that were covered with leaves and debris.
The plaintiff alleges the defendants failed to warn him about the hazardous condition of the stairs.
Carter requests a trial by jury and seeks damages in an amount that exceeds $50,000, plus the costs of this action.
