Cassens & Sons accused of selling defective Dodge Durango

EDWARDSVILLE — Two East Eaton residents are suing a Madison County car dealership for allegedly selling them a defective vehicle. 

Charles Morgan and Stacey Morgan filed a complaint on May 23 in the Madison County Circuit Court against Cassens & Sons Inc., alleging it violated the Illinois Consumer Fraud and Deceptive Business Practices Act.

According to the complaint, the plaintiffs allege that the defendant knowingly sold them a defective 2017 Dodge Durango. The plaintiffs claim they later discovered that the vehicle would "vibrate, rattle and shake when driven under normal conditions and at normal speeds" and that the rear exhaust would melt the bumper, the complaint states. 

However, the defendant allegedly told the plaintiffs that the vehicle was new and free from any defects. The defendant also failed to exchange the vehicle or issue a refund, the suit states. 

The plaintiffs request a trial by jury and seek damages in the amount of $47,120, plus punitive damages and any other relief that is fair, proper and just.
