Hubbell Power Systems allegedly breached lease

EDWARDSVILLE — A landlord claims Hubbell Power Systems breached a lease agreement.

Roscoe Building Limited Partnership filed a complaint May 24 in the Madison County Circuit Court against Hubbell Power Systems LLC, alleging it attempted to materially alter the terms of the lease by including a purported sublease.

According to the complaint, the plaintiff leased a property to Hubbell Power Systems. Then in November 2017, the defendant left the property. The plaintiff claims the defendants didn't notify it left until February and proposed a subtenant, which subsequently declined to accept the lease. The plaintiff claims Hubbell Power Systems stopped making rental payments, claiming Roscoe Building unreasonably failed to approve the proposed sublease. 

The plaintiff alleges that as a direct result of the defendant's breach, Roscoe Building will suffer damages for not receiving payments beginning in May until the end of the contract in October 2019. Payments were $34,500 per month, the complaint states. 

The plaintiff seeks judgment in its favor in the amount of $34,500 per month after April, an order declaring the defendant is obligated to pay all remaining rent due until the end of its term, attorney' fees, costs and all other relief deemed proper and just.
