BELLEVILLE — Two individuals are suing BMW Constructors Inc., Certain-Teed Corporation and several other companies for alleged negligence.
Cornelius and Doris Butler filed a complaint on May 9 in the St. Clair County Circuit Court, alleging that the defendants breached their duty to exercise reasonable care and caution for the safety of others.
According to the complaint, the plaintiffs allege that Cornelius Butler was exposed to and inhaled or ingested asbestos fibers at various times between 1955 and 1997 due to being exposed to products that allegedly were manufactured, sold, distributed or installed by the defendants.
In 2016, Cornelius Butler first became aware that he had developed cancer that allegedly was caused by being exposed to asbestos fibers. The plaintiffs hold the defendants responsible for allegedly including asbestos fibers in their products when they allegedly knew that asbestos fibers were toxic.
The plaintiffs request a trial by jury and seek compensatory and punitive damages in an amount that exceeds $50,000. They are represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
