Suit alleges driver followed too closely in Missouri Avenue collision

Car accident 17

BELLEVILLE — A man has filed a lawsuit claiming a motorist drove too fast and crashed into the back of his vehicle.

Wilke Rice filed a complaint May 11 in the St. Clair County Circuit Court against Kurt Mundloch alleging he failed to exercise the highest degree of care while operating an automobile.

According to the complaint, the plaintiff alleges that on Jan. 3, 2017, he was traveling east on Missouri Avenue near its intersection with 27th Street when the defendant caused his vehicle to crash into plaintiff's vehicle.

The plaintiff claims he suffered injuries to his back, neck, and chest and incurred medical expenses totaling about $20,000.

The plaintiff holds Mundloch responsible because he allegedly negligently drove his vehicle at an excessive speed, failed to keep a proper lookout and followed the plaintiff's vehicle too closely.

The plaintiff seeks judgment against the defendant in an amount in excess of the jurisdictional limits of the court, plus costs expended herein and other relief deemed appropriate under the circumstances.

He is represented by Scott L. Kolker of Defeo & Kolker LLC in Clayton.
