Couple seeks over $50K from Uniroyal, others in asbestos lawsuit

BELLEVILLE — A husband and wife are suing numerous companies, citing alleged failure to warn and negligence.

Lindburgh Aiken Sr. and Esther Aiken filed a complaint April 24 in the St. Clair County Circuit Court against Borg-Warner Morse TEC LLC, Heidelberg USA Inc., Uniroyal Inc., et al, alleging they failed to exercise ordinary care for the safety of others.

According to the complaint, the plaintiffs say that during Lindburgh Aiken's career, he was exposed to and inhaled or ingested asbestos fibers in certain products manufactured, sold, distributed or installed by the defendants. That on or about Nov. 13, he became aware he developed lung cancer and claims the disease was wrongfully caused and is due to asbestos. The plaintiffs hold the defendants responsible because they allegedly included asbestos fibers in their products and failed to provide adequate warnings and instructions concerning the dangers of working around products containing asbestos fibers.

The plaintiffs seek damages of more than $50,000. They are represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
