Man claims Riley Power, others should have known about asbestos' effects on human health

BELLEVILLE — A former mechanic claims he developed mesothelioma and that it is an asbestos-induced disease.

George Wiley Bingham filed a complaint May 10 in the St. Clair County Circuit Court against 3M Co., Dana Cos. LLC, Riley Power Inc. and others alleging they breached their duties to exercise due care and caution for the safety of others.

According to the complaint, the plaintiff alleges that when he worked as a maintenance mechanic from 1969 to 1991, he was exposed to asbestos fibers emanating from certain products manufactured, distributed, sold or installed by the defendants. The complaint states that on April 6, he found out he developed mesothelioma, and he claims the disease is a result of asbestos exposure and is wrongfully caused. The plaintiff holds 3M, Dana Companies, Riley Power and others responsible because the defendants alleged included the fibers in products even though they knew the fibers would be harmful to human health. He also says they failed to provide adequate warning and instruction about the dangers of working near products containing asbestos fibers.

Bingham seeks compensatory damages of more than $50,000 and punitive damages. He is represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
