Tenant alleges injuries from broken railing

EDWARDSVILLE — A tenant is suing his landlord after the railing on the front porch broke and caused injuries. 

Steven Bernstein filed a complaint on May 7 in the Madison County Circuit Court against Michael Clements, alleging he failed to maintain the rental property in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on June 14, 2017, he was a tenant at the property being maintained by Clements when a railing on the front porch broke, causing the plaintiff to fall. 

Bernstein claims he sustained serious and permanent injuries to his left arm, left hand and right hand. 

The plaintiff alleges Clements failed to use ordinary care to prevent the railing from becoming defective, failed  to replace it or to barricade the area around the defective railing.

The plaintiff requests a trial by jury and seeks damages in a fair and reasonable amount in excess of the jurisdictional limits of the court, plus interest, costs and all further relief deemed appropriate.
