Suit alleges driver used cell phone while operating truck

BELLEVILLE — A truck driver is suing another driver for allegedly causing a collision while using his cell phone. 

Kenneth Fitzgerald filed a complaint May 1 in the St. Clair County Circuit Court against Stevens Transport Inc. and Matthew Carrero, alleging Carrero breached his duty to exercise the highest degree of care while operating a commercial vehicle.

According to the complaint, the plaintiff alleges that on Sept. 16, 2016, he was driving an International Truck on Ohio Avenue near the entrance of a Pilot Travel Center in East St. Louis when Carrero, who was working for Stevens Transport at the time, collided his Kenworth Truck into the plaintiff's truck. 

The plaintiff claims he suffered serious and permanent injuries to his head, neck, back, arms, shoulders and legs. 

Fitzgerald alleges Carrero negligently operated his truck while using a cell phone, failed to keep a proper lookout and followed the plaintiff's truck too closely.

The plaintiff seeks damages in a fair and reasonable amount, costs and expenses and all other relief deemed appropriate.
