Construction worker allegedly struck by traffic cone

EDWARDSVILLE — A construction worker from Godfrey claims he was injured when he was hit by a traffic cone.

Frank D. Anderson Jr. filed a complaint May 4 in the Madison County Circuit Court against Dale A. Wyatt, W.W. Transport Inc., J and L Tank and the Illinois Department of Transportation, alleging IDOT breached its duty to maintain a safe roadway.

According to the complaint, the plaintiff alleges that on May 6, 2016, he was working in a construction zone in Foster Township when he was hit by a traffic cone that Wyatt, who was acting as an agent for W.W. Transport and J and L Tank, struck. 

Anderson claims he sustained extensive injuries to his neck, right calf, hips and back. 

The plaintiff alleges Wyatt failed to maintain a careful lookout and failed to reduce his speed or swerve to avoid hitting objects in the roadway.

The plaintiff seeks a judgment against each defendant in a sum in excess of $50,000, plus costs of this action and any further relief that the court deems just and proper.
