Tenant sues Edwardsville landlord over staircase fall

EDWARDSVILLE — A tenant is suing a rental property owner, claiming he was injured after falling down stairs.

Timothy Abernathy filed a complaint April 18 in the Madison County Circuit Court against Joseph Hamilton, alleging he breached his duty to ensure his tenants' safety.

According to the complaint, the plaintiff alleges that on April 18, 2016, he fell down the stairs to the basement at the defendant's rental property in Edwardsville. 

Abernathy claims he sustained serious injuries, including a subdural hematoma, fractured temporal bones, sprains and other injuries. 

The plaintiff alleges Hamilton failed to install a handrail on the stairwells and failed to warn tenants that there was no handrail on that staircase.

The plaintiff seeks damages of more than $50,000, plus costs of this action.
