BELLEVILLE — A man claims he was hit by a vehicle while trying to move a tree limb blocking a road.

Garry B. Kelly Jr. filed a complaint April 3 in the St. Clair County Circuit Court against James R. Reimann, alleging he failed to exercise due care and caution while driving a motor vehicle.

According to the complaint, the plaintiff alleges that on Sept. 4, he was seriously injured when he was struck by defendant's vehicle while he was helping a person remove a tree limb that was blocking State Route 4 in Lebanon. 

He claims he suffered injuries, resulting in medical, hospital and rehabilitation expenses as well as disability, pain, emotional distress and lost wages. 

The plaintiff alleges Reimann breached his duty to operate his vehicle in a safe manner by failing to keep an adequate lookout, driving his vehicle at a speed greater than was reasonable and failing to maintain proper control of it.

The plaintiff seeks a judgment against the defendant in excess of $50,000, costs of court and all other relief that are proper and just.
