Motorist, passenger sue over I-55 collision

EDWARDSVILLE — A motorist and a passenger are suing a truck driver and his employer for allegedly causing a collision on Interstate 55.

Linda Passini and John R. Rhine filed a complaint on April 2 in the Madison County Circuit Court against the Richard D. Jordan and Davis Brothers Inc., alleging Jordan failed to maintain proper control of the tractor trailer owned by Davis Brothers.

According to the complaint, the plaintiffs allege that on Dec. 15, 2017, they were traveling northbound on Interstate 55 near mile post 22.75 when Jordan, who was in the course and scope of his employment with Davis Brothers, caused the tractor trailer he was driving to collide with the plaintiffs' vehicle. 

The plaintiffs claim they sustained internal and external injuries resulting in disability, disfigurement, pain and mental anguish and lost wages. 

The plaintiffs allege Jordan failed to maintain careful lookout, followed their vehicle too closely and failed to take evasive actions to avoid a collision.

The plaintiffs request a trial by jury and seek damages in a fair amount exceeding $50,000, plus costs of suit.
