EDWARDSVILLE — A passenger injured in a collision with a train is suing a property owner for allegedly failing to install railroad crossing signals.
Demetrius Williams filed a complaint on March 23 in the Madison County Circuit Court against Roesch Inc., alleging it breached its duty to provide a safe thoroughfare.
According to the complaint, the plaintiff alleges that on March 25, 2016, he was a passenger in a motor vehicle driven by Pamela Adams when they collided with a train operated by Norfolk Southern Railway Company on the tracks located on the defendant's property.
Williams alleges the defendant failed to install railroad crossing signals to warn of any oncoming locomotives.
As a result, the plaintiff claims he suffered injuries to his legs, neck, back and arm, requiring surgical intervention.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000, plus costs, expenses and all other relief that are just and proper.
