Man alleges brain injury after hitting head on dump truck

BELLEVILLE — A union operating engineer alleges a dump truck driver caused the truck to strike the plaintiff in the head while attempting to free the vehicle from the mud. 

Brian Embrich filed a complaint on March 9 in the St. Clair County Circuit Court against Beelman Truck Co., alleging the dump truck owner negligently entrusted its vehicle to a careless driver.

According to the complaint, the plaintiff alleges that on April 27, 2015, he was injured on a construction site when he was struck on the head by a Beelman dump truck. He claims the dump truck driver caused it to swing sideways. 

As a result, Embrich claims he suffered injuries to various parts of his body, including but not limited to traumatic brain injury that required surgery. 

The plaintiff alleges the defendant's employee caused its truck to be stuck in the mud and negligently accelerated it in reverse while being towed.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $25,000, plus costs of suit.
