CBS, GE, others failed to warn of asbestos risks, suit alleges

BELLEVILLE — A man is suing 10 companies, claiming they did not warn about the risks of working around asbestos.

Alfred Fohan filed a complaint March 8 in the St. Clair County Circuit Court against CBS Corp., General Electric Co., Union Carbide Corp. and others alleging that they breached their duties to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiff alleges during his career, he was exposed to asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. On Feb. 8, 2017, he was diagnosed with lung cancer, which the suit says is an asbestos-induced disease that was wrongfully caused. The plaintiff holds the defendants responsible because they allegedly intentionally included asbestos fibers in their products when they knew that it had a negative effect on human health and failed to provide adequate warnings and instructions about the dangers of working around asbestos-containing products.

The plaintiff requests a trial and seeks compensatory damages of not less than $50,000. He is represented by Ethan A. Flint and Laci M. Whitley of Flint Law Firm LLC in Edwardsville.
