Widow seeks damages from Grinnell, others after husband's cancer death

Asbestos 03

BELLEVILLE — A widow claims her husband's cancer death in 2017 is a result of asbestos exposure.

Carolyn Bacon, individually and as special representative of the estate of Ed H. Bacon, deceased, filed a complaint March 12 in St. Clair County Circuit Court against Borg-Warner Morse TEC LLC, Grinnell LLC, Spence Engineering Co. Inc. and others alleging they failed to exercise due care and caution for the safety of others.

According to the complaint, the plaintiff alleges that during Ed Bacon's life, he was exposed to asbestos fibers from certain products manufactured, sold, distributed or installed by the defendants. On Nov. 9, 2015, he learned he developed lung cancer, which ultimately led to his death Feb. 2, 2017. The plaintiff holds the defendants responsible because they allegedly negligently included asbestos fibers in their products when substitutes were available and failed to provide adequate warnings and instructions about the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks compensatory and punitive damages of more than $50,000. She is represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
